DoubleCheck Terms of Service

These Terms of Service (“Terms”) govern your access to and use of DoubleCheck’s websites, widgets, applications, dashboards, APIs, and related services (collectively, the “Service”). These Terms form a binding agreement between you and DoubleCheck (“DoubleCheck,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Who These Terms Apply To
The Service may be used in three primary ways:
Free DoubleCheck (Individual Use):
You use DoubleCheck directly as an individual.DoubleCheck for Institutions (Business Use):
An organization (an “Institution”) subscribes to DoubleCheck and may use DoubleCheck internally and/or make DoubleCheck available to its customers, members, residents, patients, students, employees, or other end users.End Users via Institutions:
You access DoubleCheck through an Institution (e.g., via an embedded widget in a portal or app).
If you are using DoubleCheck on behalf of an Institution or other entity, you represent that you have authority to bind that entity to these Terms.
If you use DoubleCheck through an Institution, the Institution may also have its own terms, policies, or notices that apply to you in addition to these Terms.
2) Definitions
“Content”
means text, messages, transcripts, screenshots, URLs, files, and other information submitted to or generated by the Service.“Institution Content”
means content, configuration, verified contact details, and settings provided by an Institution for its deployment of DoubleCheck.“Output”
means results generated by DoubleCheck, including classifications, risk indicators, summaries, recommended next steps, action cards, routing metadata, and evidence pack materials.
3) The Service and Important Disclaimers
3.1 DoubleCheck is Not Emergency Services
DoubleCheck is not a law enforcement, emergency response, or 911 service. If you believe you are in immediate danger or facing an emergency, call local emergency services immediately.
3.2 DoubleCheck Does Not Provide Legal, Financial, or Medical Advice
DoubleCheck provides scam and fraud triage, safety guidance, and information intended to help users recognize and respond to suspicious activity. DoubleCheck does not provide legal advice, financial advice, investment advice, tax advice, medical advice, or professional services. You are responsible for deciding what actions to take.
3.3 No Guarantee of Accuracy or Outcome
Scams evolve quickly. While DoubleCheck aims to identify patterns and provide helpful guidance, DoubleCheck does not guarantee that:
- any message or situation is definitively a scam or legitimate,
- following guidance will prevent loss or harm, or
- any recovery, refund, dispute, or investigation will succeed.
4) Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian and to the extent permitted by law.
5) Accounts, Authentication, and Access
Some features require an account (particularly for Institutions and their staff). You agree to provide accurate information, keep credentials secure, and promptly notify us of unauthorized access.
Institutions are responsible for managing their users, roles, access policies, and configurations for their deployment of DoubleCheck.
6) Acceptable Use
You agree not to misuse the Service. You will not (and will not allow anyone else to):
- use the Service for unlawful, harmful, or fraudulent purposes;
- submit content that you do not have the right to use or that violates privacy or confidentiality obligations;
- attempt to gain unauthorized access to the Service or related systems;
- interfere with the Service, including by introducing malware or attempting denial-of-service attacks;
- scrape, harvest, or collect data from the Service beyond what is permitted;
- reverse engineer, copy, or exploit the Service except as allowed by law or written agreement;
- use the Service to generate or distribute scams, phishing, impersonation, fraud, or other deceptive content.
We may suspend or terminate access for violations of these Terms.
7) User Content and Responsibilities
7.1 Your Content
You are responsible for the Content you submit and the decisions you make based on the Output.
You should avoid submitting sensitive personal data unless necessary for your situation. Do not submit:
- Social Security numbers,
- full bank account numbers,
- full payment card numbers,
- credentials or one-time passcodes,
unless the Service explicitly requests it and you understand why it is needed.
7.2 Institution Content
Institutions are responsible for the accuracy and appropriateness of their Institution Content, including verified phone numbers, official links, emails, and other configuration details. Institutions must ensure they have rights to provide Institution Content and that it does not violate applicable law or third-party rights.
8) Output and Human Judgment
DoubleCheck Output may include classifications, risk signals, summaries, and recommended next steps. Output is informational and may be incomplete or incorrect. You should independently verify critical information through official channels.
Institutions should not rely solely on DoubleCheck Output for compliance, legal determinations, or final adjudication decisions.
9) Evidence Packs and Routing
The Service may generate structured summaries (“evidence packs”) and routing metadata to support organizational workflows (e.g., customer support, fraud operations, or incident reporting). Evidence packs are compiled from user-provided information and automated analysis.
DoubleCheck does not guarantee completeness of evidence packs and does not independently authenticate all submitted artifacts.
10) Privacy and Threat Intelligence Use
Your use of the Service is also governed by our Privacy Policy. In addition:
- DoubleCheck may retain and process Content and Output to operate the Service, maintain security, prevent abuse, and improve performance.
- DoubleCheck may anonymize and aggregate data to identify new and emerging scams, fraud patterns, and threats and to improve DoubleCheck’s detection capabilities. Anonymized/aggregated information is not intended to identify you.
- If you use DoubleCheck through an Institution, the Institution may have additional privacy disclosures governing its relationship with you.
11) Paid Plans, Fees, and Taxes (Institutions)
If you purchase a paid plan, you agree to pay all fees and applicable taxes according to your order form, subscription page, or written agreement with DoubleCheck.
Unless otherwise stated:
- fees are non-refundable,
- charges may be based on usage metrics (e.g., per incident analyzed, per conversation/case, or tier limits),
- we may change pricing with notice for renewals or future terms.
12) Third-Party Services and Integrations
The Service may integrate with or link to third-party services (e.g., ticketing systems, analytics, identity platforms) at the direction of an Institution or user. Your use of those third-party services is governed by their terms. DoubleCheck is not responsible for third-party services.
13) Intellectual Property
DoubleCheck and its licensors own all rights, title, and interest in and to the Service, including software, models, workflows, user interfaces, branding, and documentation.
You receive a limited, non-exclusive, non-transferable, revocable right to access and use the Service in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, or create derivative works of the Service except as expressly permitted.
14) Feedback
If you provide suggestions or feedback, you grant DoubleCheck the right to use it without restriction or compensation.
15) Suspension and Termination
We may suspend or terminate your access to the Service:
- if you violate these Terms,
- if your use poses a security risk,
- if required by law,
- or if your account is inactive for an extended period (where applicable).
You may stop using the Service at any time. Institutions may terminate according to their contract or subscription terms.
Sections that by their nature should survive termination (e.g., disclaimers, limitation of liability, indemnification) will survive.
16) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAMGUARD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SCAMGUARD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE OR COMPLETE.
17) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- SCAMGUARD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- SCAMGUARD’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT PAID BY YOU TO SCAMGUARD FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, liability will be limited to the greatest extent permitted by law.
18) Indemnification
You agree to indemnify and hold harmless DoubleCheck and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:
- your Content,
- your use of the Service in violation of these Terms,
- your violation of law or third-party rights.
Institutions additionally agree to indemnify DoubleCheck for claims arising from Institution Content, institution-directed configurations, and institution-directed integrations, to the extent permitted by law and subject to any separate written agreement.
19) Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
Unless otherwise required by applicable law, you agree that any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Michigan, and you consent to personal jurisdiction and venue in those courts.
20) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date and may provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
